Individual manufacture and a statutory right of withdrawal must be carefully distinguished. Here we explain what matters for your order.
Bespoke goods: when is there no right of withdrawal?
Under section 312g(2)(1) of the German Civil Code (BGB), contracts covered by that provision carry no statutory right of withdrawal for goods that are not prefabricated and whose manufacture is determined by your individual choice or specification, or that are clearly tailored to your personal needs.
Whether this exception applies depends on the goods actually agreed. The label ‘made to measure’, choosing a standard variant or ticking a confirmation box is not automatically enough. We therefore record your individual design specifically before the contract. Where the exception applies, we inform you before your binding order.
Where a statutory right of withdrawal exists
For distance or off-premises contracts, consumers generally have a 14-day right of withdrawal unless a statutory exception applies. Its start and expiry depend on the legal requirements, particularly receipt of the goods and proper instructions. No reason for withdrawing is required.
For such a contract, before it is concluded you receive withdrawal instructions tailored to the order, including return arrangements and any return costs. For furniture that cannot be sent as a parcel, return costs payable by you must be specified or, where necessary, estimated before the contract. Rights relating to defects remain
Excluding a right of withdrawal does not exclude statutory claims for faulty, damaged or non-conforming furniture. Please contact us with complaints. Payment already made or photos and videos sent do not remove these rights either.
Orders placed in the shop
A purchase contract concluded exclusively in the shop generally carries no statutory right of withdrawal simply because you change your mind. Statutory rights relating to defects and any expressly agreed return options remain unaffected.
