General terms and conditions of Sofastil Berlin, proprietor Yusef Nasser, Wilmersdorfer Straße 142, 10585 Berlin.
1. Scope
These terms apply to contracts for furniture, mattresses, toppers and fabric sold by the metre, including agreed planning, delivery and assembly services, where validly incorporated before the contract is concluded. Individual agreements take precedence. Mandatory statutory rights remain unaffected. A consumer is any natural person acting predominantly for private purposes.
2. Enquiries and formation of contract
The content on this website is for information and is not a binding contractual offer. An enquiry through the website, by email, phone or WhatsApp is non-binding. No binding order or payment is made through this website.
We reply to your enquiry as soon as possible. After checking availability or sourcing and discussing the details, we send a quotation stating the specification, total price including taxes and shipping, agreed services and delivery time. A contract is concluded when you accept our binding quotation within its stated acceptance period. Different requirements need a new agreement. The contract language is German.
Before the contract is concluded, you receive the relevant contractual information and these terms. Please retain the quotation, acceptance and any other agreements. This website does not offer a customer account providing access to contractual documents.
3. Individual design
The characteristics agreed before the contract are decisive, particularly model, quantity, dimensions, corner orientation, upholstery material, colour, padding, functions and accessories. We clarify any open points before a binding order. A later selection is not used to remove an existing right of withdrawal.
Product photos and catalogue dimensions are for guidance unless expressly agreed as part of the contract. Room scenes labelled as AI images are design examples. Screens may display colours differently from original samples. This does not limit claims arising from differences from the agreed characteristics.
Suitability of upholstery, special care properties or water resistance apply only to the extent specifically agreed. We do not give a blanket assurance that all upholstery is waterproof.
4. Changes after the contract is concluded
We assess changes for technical feasibility and the stage of production. Additional costs and effects on delivery timing are agreed before any change. Silence does not constitute consent. Statutory rights to rescind or terminate and rights relating to defects remain unaffected.
5. Prices and payment
Total prices shown to consumers include statutory VAT. Delivery, assembly and other agreed additional costs are listed in the quotation before the contract is concluded. Additional services that have not been agreed are not charged automatically.
For in-stock furniture, mattresses, toppers and fabrics, payment is by bank transfer after availability and the quotation are confirmed and you have accepted. We personally provide the bank details, invoice amount and due date. Dispatch or delivery takes place on the confirmed schedule after the agreed payment is received. For sourced goods, sourcing, delivery time and payment are agreed before the contract is concluded.
For furniture made specifically for you, our intended payment schedule is 60% of the agreed total after the contract is concluded and before production, and 40% after full completion and after we send photos and a video of the finished piece, before delivery. The specific payment agreement, due dates and method are set out in the quotation and invoice; statutory objections and rights of retention remain unaffected.
Photos and video are provided for information. Receiving them, making payment or remaining silent does not constitute acceptance of the work or a waiver of claims for defects or services not performed.
6. Delivery and assembly
Delivery location, scope, costs and lead time are agreed before the contract is concluded. Within Berlin we offer delivery into the home including assembly. The quotation expressly states whether these services are included in the furniture price. Outside Berlin, scope and costs are agreed individually.
Please provide the information needed for delivery, such as floor, lift, door and stair dimensions and visible access obstacles. We plan delivery accordingly. If special equipment or further services are needed, their scope and costs are agreed separately. We do not place blanket responsibility for all delivery obstacles on you.
We inform you of foreseeable delays. This does not restrict your statutory rights if delivery is late or fails. In consumer sales, the risk of accidental loss or damage generally passes only on delivery to you or an authorised recipient; statutory exceptions remain unaffected.
7. Withdrawal for individually made goods
Consumers may have a statutory right of withdrawal for distance contracts and contracts concluded away from business premises. The exception for certain individually made goods is governed by section 312g(2)(1) of the German Civil Code (BGB). It applies only where the legal requirements are met in the individual case. Merely describing goods as ‘bespoke’ or providing a confirmation does not remove a right of withdrawal. Further information is available under Withdrawal & bespoke orders. Where a right of withdrawal exists, you receive instructions tailored to your contract before it is concluded.
8. Defects and liability
Statutory rights relating to defects and statutory liability apply. Individual manufacture does not exclude them. An additional guarantee exists only if expressly promised with its scope and conditions.
Please report visible damage or discrepancies as soon as reasonably possible, with a description and ideally photos. For consumers, this is not a cut-off deadline; statutory claims are not lost if damage is not reported immediately. Contact sofastilberlin@gmail.com or +49 175 7009080.
9. Consumer dispute resolution
